Dotpreneur® does not intentionally provide its Services to individuals under the age of eighteen (18). If we become aware of a person under the age of eighteen (18) accessing or using Dotpreneur® services, we will take the following actions:
• Account Termination: We will promptly prohibit and block such Account without prior notice.
• Data Deletion: We will make all reasonable efforts to promptly delete any data associated with such Account.

8.1 Raising a Complaint: If you are not satisfied with any aspect of our services, please contact us immediately. Please provide as much detail as possible about the nature of your complaint, including the service you are unhappy with, and any specific incidents that occurred.

b. Ensure that all Content supplied to Dotpreneur® is lawful, appropriate, and does not contain any discriminatory, defamatory, abusive, inappropriate, obscene, or offensive language. The content should be true, current, and accurate, and should not contain any harmful elements or provide any false or misleading information. 11.2 Dotpreneur® makes no warranties or representations regarding the performance, security, reliability, or compatibility of any third-party code or API used within the service. Users acknowledge and agree that the use of such third-party resources is at their own risk.
12. Indemnities and Limitation of Liability
12.1 You shall indemnify and hold harmless Dotpreneur® and its Affiliates and its and their respective directors, officers, employees, agents, contractors, third-party service providers and partners from and against any and all liabilities, actions, proceedings, claims, demands, costs and expenses (including legal expenses) arising out of or in connection with:
a. your use of the Dotpreneur® services provided by Dotpreneur® to you, including but not limited to career counseling, founder coaching, training, and mentoring services;
b. the Content;
c. any reports, declarations, calculations, or other information that are produced through, derived from, or otherwise connected to Dotpreneur® services;
d. Your violation of the Agreement;
e. claims from third parties arising out of your cancellation and/or termination of the Agreement; and/or
f. any negligent act, omission or wilful conduct, misconduct or fraud of you, or your Authorised Users, officers, employees, agents, or independent contractors; and
g. any dispute, contention, or claim of ownership of the Content.
12.2 You shall indemnify Dotpreneur® against any and all liability, loss, damage, costs and expenses which Dotpreneur® or a third-party may incur or suffer whether direct or consequential (including any economic loss or other loss of profits, business or goodwill) as a result of any dispute or contractual, tortious or other claims or proceedings brought against Dotpreneur® by a third-party alleging infringement of its Intellectual Property Rights by reason of your use or exploitation of the Dotpreneur® services and/or the Content.
12.3 Each indemnity in these Terms and Conditions is a continuing obligation and survives expiry or termination of the Agreement or expiry of any Subscription Term.
12.4 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DOTPRENEUR®’S AGGREGATE LIABILITY FOR ANY CLAIMS UNDER OR PURSUANT TO THE AGREEMENT EXCEED THE AGGREGATE FEES ACTUALLY PAID BY YOU FOR THE PRECEDING TWELVE (12) MONTH PERIOD AT THE POINT IN TIME WHEN THE CLAIM(S) IS/ARE MADE AGAINST DOTPRENEUR®.
12.5 Notwithstanding any other provision in the Agreement and to the maximum extent permitted by applicable law, under no circumstances shall Dotpreneur® be liable for any direct, indirect, consequential or special loss or damage relating to (i) disruptions or interruptions to the internet that may affect the use of the Dotpreneur® services; (ii) errors, delays or technological failures that may prevent Dotpreneur® from providing the Dotpreneur® services or related services; (iii) loss of your data or Content; (iv) damage, disruption or injury to your webpage or website; and (v) any delay or failure in performance caused by events beyond the reasonable control of Dotpreneur®, even if Dotpreneur® was advised of the possibility of such damages or if such possibility was reasonably foreseeable.
13. Disclaimers
13.1 You expressly understand and agree that:
a. YOUR USE OF THE DOTPRENEUR® SERVICES, INCLUDING BUT NOT LIMITED TO CAREER COUNSELING, FOUNDER COACHING, TRAINING, AND MENTORING SERVICES, IS AT YOUR OWN RISK. THE DOTPRENEUR® SERVICES ARE PROVIDED BY DOTPRENEUR® ON AN “AS IS” BASIS. DOTPRENEUR® EXPRESSLY DISCLAIMS, TO THE FULLEST EXTENT PERMITTED BY LAW, ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED BY STATUTE, COMMON LAW OR OTHERWISE, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, RELIABILITY, PERFORMANCE, SECURITY, CONTINUED AVAILABILITY, OR INTER-OPERABILITY WITH OTHER SYSTEMS OR SERVICES;
b. Dotpreneur® makes no warranty that:
i. The Dotpreneur® services will meet your requirements. The services are intended to support and assist you in reaching your own goals, but your success depends on your own effort, motivation, commitment and follow-through. Dotpreneur® cannot predict and does not guarantee that you will attain a particular result.
ii. The quality of the Dotpreneur® services, information or other material purchased or obtained by you from Dotpreneur® will meet your expectations. It’s important to note that all services are subjective and depend greatly on your own interpretation and implementation.
iii. The information and content provided on the Dotpreneur® services is complete, accurate, or current. While Dotpreneur® strives to provide accurate and up-to-date information, it cannot guarantee the validity or timeliness of the content.
13.2 For the avoidance of doubt, no advice or information, whether oral or written, obtained by you from Dotpreneur® or its employees or agents shall create any condition, warranty or guarantee not expressly stated in the Agreement.
14. Personal Information and Personal Data
14.1 You acknowledge that Dotpreneur® may collect, use, store, and disclose your Personal Data for the purposes as set out in our Privacy Policy, and all Personal Data provided by you is subject to our Privacy Policy. This includes data related to your use of our career counseling, founder coaching, training, and mentoring services.
14.2 Dotpreneur® shall comply with the Data Protection Laws relating to the collection, use, disclosure and retention of Personal Data. This applies to all data collected in the course of providing our services.
14.3 You undertake that you will comply with all Data Protection Laws. If you provide to Dotpreneur® any Personal Data relating to a third-party (including in the Customer Personal Data), by submitting such information to us, you warrant and represent to us that you have obtained the consent of such third-party to you providing us with their Personal Data for the collection, use, and disclosure of their Personal Data for all purposes set out in our Privacy Policy, by or for the benefit of the persons referenced in the same, and the provision of the Product to you.
15. Term and Termination
15.1 Dotpreneur® may immediately terminate any Account/ License and/or the Agreement, terminate or suspend your access to all or part of the Dotpreneur® services, including but not limited to career counseling, founder coaching, training, and mentoring services:
a. if you commit a material breach of any of your obligations under the Agreement. A ‘material breach’ refers to a significant violation of the terms that affects the very essence of the contract. This could include, but is not limited to, failure to make a required payment, unauthorized use of services, violation of the intellectual property rights clause, or any other action that fundamentally undermines the purpose of the agreement;
b. if any of the representations or warranties you make pursuant to the Agreement are incorrect;
c. if required by any law or regulation, or by any enforcement or other government agency or regulatory authority;
d. if you or your Content infringe any Intellectual Property Rights of Dotpreneur® or any third-party;
e. in the event of discontinuance or material modification to the Dotpreneur® services, the sites and/or the Services or part thereof;
f. in the event of any unexpected technical or security issues; and
g. in the event of a Security Event.
15.2 Termination of Agreement shall be without prejudice to any other rights or remedies Dotpreneur® may be entitled to under the Agreement, at law or in equity and shall not affect any accrued rights or liabilities nor the coming into or continuance in force of any provision which is expressly or by implication intended to come into or continue in force on or after such termination.
16. User Responsibilities
16.1 As a user of Dotpreneur® services, you agree to:
a. Comply with all terms and conditions outlined in this Agreement;
b. Use the services in a manner that is respectful and considerate of Dotpreneur® and other users;
c. Provide accurate and truthful information when creating an account and using the services;
d. Keep your account credentials secure and notify Dotpreneur® immediately if you suspect unauthorized access;
e. Not use the services for any illegal activities or to infringe upon the rights of others;
f. Not share or distribute content from the services without proper authorization;
g. Not interfere with the operation of the services or disrupt the experience for other users.
17. Payment Terms
17.1 All fees for the services provided by Dotpreneur® are due as set forth in the specific terms of the service package selected by you.
17.2 Payments are to be made in the currency specified in the service package. All wire transfer fees, intermediary fees, or other like fees are your responsibility and are to be paid in addition to the service fees.
17.3 If you fail to make any payment by the due date, Dotpreneur® reserves the right to suspend or terminate your access to the services.
17.4 All payments made are non-refundable, except as specifically provided in these Terms and Conditions or in the applicable service package.
17.5 Dotpreneur® reserves the right to change its prices at any time. Price changes will not affect any services that have already been paid for.
18. Confidentiality
18.1 You agree to keep confidential, and to procure that the Authorised Users keep confidential, any Confidential Information, and shall not disclose the Confidential Information to any other person unless disclosure has been expressly permitted by Dotpreneur® in writing. You agree and acknowledge that Confidential Information shall only be used for the purposes of the Agreement and/or in performing your obligations under the Agreement. This includes any information related to the career counseling, founder coaching, training, and mentoring services provided by Dotpreneur®.
18.2 You shall immediately notify Dotpreneur® if you suspect, or become aware of, any unauthorised reproduction, use, disclosure, transfer or storage of Confidential Information.
18.3 The provisions of this clause shall survive and continue to remain in full force and effect notwithstanding any expiry or termination of the Agreement.
19. Progress Tracking and Feedback
19.1 As part of the coaching and mentoring services provided by Dotpreneur®, you may have the opportunity to track progress, provide feedback, or compile overviews of your sessions. While Dotpreneur® may provide tools and services to assist in these activities, you acknowledge and agree that any tools and services provided to you are provided merely as a convenience to you. You retain sole responsibility for ensuring the timeliness, accuracy, and completeness of any progress tracking documents, feedback forms, or session overviews you wish to generate and/or submit to Dotpreneur or third parties.
20. User Conduct
20.1 As a user of Dotpreneur® services, you agree to conduct yourself in a respectful and professional manner. You agree not to use the services for any unlawful purposes or in any way that could harm Dotpreneur® or any other person.
20.2 You agree not to post or transmit any material that is abusive, harassing, defamatory, obscene, fraudulent, or violates the rights of others, or any material that interferes with the operation of the services, including but not limited to, computer viruses or other malicious software.
20.3 You agree not to advertise or sell goods or services to other users of Dotpreneur® services without the express consent of Dotpreneur®.
20.4 You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account. You agree to notify Dotpreneur® immediately of any unauthorized use of your account or password, or any other breach of security.
21. Anti-Bribery and Corruption
21.1 You represent and covenant that you will:
a. comply with all anti-bribery laws and regulations;
b. not engage in, encourage, permit, condone, or tolerate any form of bribery and corruption whatsoever, whether direct or indirect, and whether financial in nature or otherwise;
c. not do, or omit to do, anything that may cause Dotpreneur® to be in breach of any anti-bribery laws and regulations; and
d. maintain and enforce adequate and effective anti-bribery and corruption policies and procedures designed to promote and ensure that you shall at all times comply with applicable anti-bribery laws and regulations when using Dotpreneur®'s career counseling, founder coaching, training, and mentoring services.
21.2 To the extent permitted by law, you shall promptly notify Dotpreneur® of any investigation by a governmental authority (including without limitation, regulatory agencies) or violations by you of any law or regulation with respect to anti-bribery or anti-corruption laws and any matters relating in any way to the Agreement or which could potentially impact the continuity of your performance of the Agreement.
22. Force Majeure
22.1 No failure or omission by Dotpreneur® to carry out its obligations or observe any of the stipulations or conditions of the Agreement, shall give rise to any claims against Dotpreneur® or be deemed a breach of the Agreement, in the event that such failure or omission arises from a cause of force majeure. This includes acts of God, new statutory enactments or modifications, war or warlike hostilities, pandemics, epidemics, acts of terrorism, civil commotion, riots, blockades, embargoes, sabotage, strikes, lockouts, shortage of material or labor, delay in deliveries from sub-contractors, machine failure caused by force majeure, or any other event that is unforeseeable and outside the reasonable control of Dotpreneur®. Upon the occurrence of any event mentioned in this clause, Dotpreneur® shall for the duration of such event(s) be relieved of any obligation under the Agreement as is affected by the event(s). However, the provisions of the Agreement shall remain in force with regard to all other obligations under the Agreement which are not affected by the event(s).
23. Notices
23.1 All notices from you to Dotpreneur® regarding the Agreement shall be sent via e-mail to (copying support@dotpreneur.io). Communications delivered by email shall be effective when actually received by Dotpreneur® in readable form and subject to there being no bounce-back notification and/or sending failure notification.
23.2 Dotpreneur® will send notices and other communications to you at the email address you have provided to us in your account. It is your sole responsibility to ensure that you provide Dotpreneur® with your current contact email address when using our career counseling, founder coaching, training, and mentoring services.
24. General
24.1 Entire Agreement: The Agreement constitutes the entire agreement between Dotpreneur® and you in relation to their subject matter and supersedes any prior agreements, discussions, representations and undertakings between the parties (whether written or oral).
24.2 Variation: Dotpreneur® may amend the Agreement at any time and may provide a notice to you. The amended Agreement will be made available on the Platform. You are advised to check for amendments to the Agreement regularly, prior to using the Dotpreneur® services. Your continued use of the Dotpreneur® services, including but not limited to career counseling, founder coaching, training, and mentoring services, shall constitute your agreement to the revised Agreement.
24.3 No Waiver: Any failure by either Parties to exercise or enforce any right or provision of the Agreement shall not constitute a waiver of such right or provision. The rights and remedies provided in the Agreement are cumulative and not exclusive of any rights or remedies (whether provided by law or otherwise).
24.4 Illegality: Should any provision of the Agreement be held invalid, illegal or unenforceable in any respect under the law of any jurisdiction, the remaining provisions of the Agreement shall be unaffected and shall remain in full force and effect and the Agreement will be amended to give effect to the eliminated provision to the maximum extent possible.
24.5 Third Party Rights: Except as expressly set out in the Agreement, any person not a party to the Agreement shall acquire no rights whatsoever under the Agreement.
25. Governing Law and Dispute Resolution
25.1 The Agreement shall be governed by and construed in accordance with the laws of Spain or the European Union, and any claims or disputes of whatever nature shall be subject to the exclusive jurisdiction of the courts in Spain or the European Union.
26. User Account
26.1 Account Creation: To access certain features of Dotpreneur® services, including career counseling, founder coaching, training, and mentoring services, you may be required to create an account. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure.
26.2 Account Security: You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. Dotpreneur® encourages you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. Dotpreneur® cannot and will not be liable for any loss or damage arising from your failure to comply with the above.
26.3 Account Usage: Your account is personal to you and you are prohibited from providing any other person with access to the Services or portions of it using your username, password, or other security information. You must notify us immediately of any unauthorized access to or use of your username or password or any other breach of security.
26.4 Account Termination: Dotpreneur® reserves the right to terminate your account at any time for any reason, including but not limited to, breach of the Terms & Conditions, providing false account information, or non-payment of services.
27. User Content
27.1 Content Responsibility: You are solely responsible for all content, including but not limited to text, images, videos, and other materials, that you upload, post, or otherwise transmit (“Content”) while using Dotpreneur® services. You agree not to post or transmit any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
27.2 Content Ownership: You retain all ownership rights in your Content. However, by submitting Content to Dotpreneur®, you hereby grant Dotpreneur® a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Service and Dotpreneur®‘s (and its successors’ and affiliates’) business.
27.3 Content Review: Dotpreneur® reserves the right (but has no obligation) to review any Content that you have submitted to the Services, and to reject, delete, remove, modify, or use such Content for any reason whatsoever, at any time, without prior notice and in its sole discretion.
27.4 Content Reporting: If you believe that any Content violates your copyright, please report it to us immediately. Dotpreneur® respects the intellectual property rights of others and expects users of the Services to do the same.
28. Links To Other Websites
28.1 Third-Party Websites: Dotpreneur® services may contain links to third-party websites or services that are not owned or controlled by Dotpreneur®. Dotpreneur® has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
28.2 No Endorsement: The inclusion of any link does not imply endorsement by Dotpreneur® of the site or any association with its operators. You acknowledge and agree that Dotpreneur® is not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.
28.3 User Responsibility: It is your responsibility to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
29. Limitation of Liability
29.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DOTPRENEUR®, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICES.
29.2 UNDER NO CIRCUMSTANCES WILL DOTPRENEUR® BE RESPONSIBLE FOR ANY DAMAGE, LOSS OR INJURY RESULTING FROM HACKING, TAMPERING OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICES OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.
29.3 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOTPRENEUR® ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICES; AND (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN.
30. Refund/Cancellation Policy
30.1 Cancellation: You may cancel your account or any services at any time. However, please note that there are no refunds for cancellation. If you cancel the services before the end of your current paid up period, your cancellation will take effect immediately and you will not be charged again.
30.2 Refunds: Payments are non-refundable and there are no refunds or credits for partially used periods. Following any cancellation, however, you will continue to have access to the service through the end of your current billing period.
30.3 Changes to Services: Dotpreneur® reserves the right to modify or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice. Dotpreneur® shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the services.
